and more...
Probate Administration is the process that takes place after a person dies with assets that are in their name individually and do not have a beneficiary designation. The process involves transferring the property to the name of the Estate under the supervision of the Probate Court. The Court process often involves preparing a detailed inventory of the probate assets, securing a corporate surety bond, notifying creditors, paying debts and taxes and the distribution of the remaining estate in accordance with the Last Will or, in cases where there is no Last Will, as state law directs.
We understand that while it can be an honor to be named as executor or personal representative, this can be a daunting role to take on when you are already grieving the loss of a loved one.
We provide knowledgeable and experienced probate representation and stay by your side each step of the process, taking into consideration that this is often an emotional journey as well.
If you are a named Trustee, our experienced team can assist you in fulfilling your fiduciary responsibilities with confidence. We focus on more than just the legal implications, but also how the intricacies of family dynamics come into play throughout the administration process.
Our unique collaborative approach to Trustee representation ensures that you feel fully supported. We communicate directly with your chosen tax professionals and financial advisors and work together to keep you on track.
Alternatively, if you are a named beneficiary of a trust, we can represent your interests, aid in the understanding and protection of your present and future rights under the Trust agreement.
Do you have a child or loved one with special needs? You needn't live in fear, worrying about what will happen to them if you were to pass away. We have worked with many families over the years in developing Special Needs Trusts to ensure that your special needs child or family member has a lifetime of support, financial management and advocacy.
Special Needs Trust Planning is unlike any other field of trust planning and requires an experienced attorney with compassion and understanding.
If you have an injury that was caused by the carelessness, negligence or intentional act of another, you may have grounds for a personal injury claim. We are happy to review your case and discuss your options.
